The intellectual property rights in all products, software and content made available to you on or through this Website or through retail stores or any alternative method remains the property of Hornit (Bullet Ventures Limited) or its licensors and are protected by copyright laws and treaties around the world.

Warranty

All Hornit products are warranted to be free from defects in materials and workmanship for a period of 12 months from the date of purchase. The warranty applies only when the product is used as intended, under normal conditions and does not apply to damage caused by wear and tear, accidents, corrosive substances, water, misuse or neglect. In all cases the warranty is limited to the value of the product. This does not affect your statutory rights.

Access to and use of "hornit.com" and "us.hornit.com" (the "Websites") and the products and services available through the Websites (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service. Access to the Websites is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason the Websites are unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of the Websites. 5. Bullet ventures limited community areas registration

Bullet Ventures Limited reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts or disrupts any of our services in any way. If you use multiple logins for the purpose of disrupting the community you may have action taken against all of your accounts.

6. Submission of material

By submitting any material to us either on the Websites or on the Hornit or Mini Hornit Facebook pages, you automatically grant Bullet Ventures Limited the royalty-free, perpetual, exclusive right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display such material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. In certain circumstances Bullet Ventures Limited may also share your contribution with trusted third parties. By submitting any material to us, you agree to use the Bullet Ventures Limited Community areas in accordance with these Terms and Conditions. If you fail to abide by these Community Rules you may be sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts. This action may include temporary or permanent suspension of your ability to participate in any or all areas of Bullet Ventures Limited. Bullet Ventures Limited reserves the right to delete any contribution, or take action against any contribution, at any time, for any reason. If you do not want to grant Bullet Ventures Limited the permission set out above on these terms, please do not submit or share your contribution on the Community website / Hornit or Mini Hornit Facebook page.

7. Terms of sale

(i) Ordering

By placing an order you are offering to purchase a product on and subject to all the terms and conditions contained herein. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure, including strikes for which we will not be responsible. In order to contract with Bullet Ventures Limited you must be over 14 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Bullet Ventures Limited retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

(ii) Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will constitute acceptance of your order. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

(iii) Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on the Websites are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. All prices are inclusive of VAT. Delivery costs may be charged in addition in which case such additional charges will be clearly displayed where applicable and included in the 'Total Cost'.

(iv) Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

(v) Discount Codes

We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though the Websites. The conditions of use relating to any discount code will be specified at the time of issue.

8. Disclaimer of liability

(a) Please refer to the “Liability” sections in the Instructions for the relevant product for a list of the disclaimers of liability. The Instructions are available on the Websites.

(b) Advice given by agents or servants of Bullet Ventures Limited during the telephone/internet orders is

based entirely upon information given by the purchaser. Where advice is given by agents or servants of Bullet Ventures Limited, such advice shall amount to an opinion only and the company shall not accept liability for any inaccuracies. Additionally, goods supplied are supplied only to correspond to the purpose for which goods of that kind are commonly supplied and not alternative uses to which they may be put.

(c) No liability for failure of any product is accepted by Bullet Ventures Limited as a result of use otherwise than in accordance with the intended use, amendment or modification. The material displayed on the Websites is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary, to the fullest extent permitted by law, Bullet Ventures Limited and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of the Websites or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. We will be responsible for any losses you suffer as a result of us breaching these conditions to the extent that such losses were reasonably foreseeable to both you and us at the time that you either you commenced using the website or bought goods from us using the site. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us at that point in time.

9. Linking to the websites

You may link to pages on the Websites, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. The Websites must not be framed on any other site, nor may you create a link to any part of the Websites other than the home page. We reserve the right to withdraw linking permission without notice.

10. Indemnity

You agree to indemnify, defend and hold harmless Bullet Ventures Limited, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use the Websites or your breach of the Terms of Service.

11. Variation

Bullet Ventures Limited shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of the Websites.

12. Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected and all other clauses shall remain in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

13. Complaints

We strive to do everything possible to make you happy with our products and customer service. However, if you are unhappy about anything at all please Contact Us and we will do everything we can to resolve the problem.

14. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

15. Governing law and jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

16. Entire agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Bullet Ventures Limited. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Bullet Ventures Limited.

17. Warranty

18. Delivery and returns (products ordered from the websites only)

(i) Delivery

(a) Bullet Ventures Limited will send all purchases within the UK by Royal Mail 1st Class post unless otherwise instructed as part of the order process. We commit to deliver purchases within 7 working days from order confirmation although we aim to deliver them within the time stated on the Delivery page of the relevant Website. Time shall not be of the essence.

(b) International purchases will be shipped by the method most suitable to the destination unless otherwise instructed as part of the order process. Bullet Ventures Limited commits to deliver within 21 working days of purchase although we aim to deliver them within the time stated on the Delivery page of the relevant website. Time shall not be of the essence.

(ii) Returning a Faulty Product and Discrepancies (for Hornit products bought anywhere)

(a) We want you to be happy with every Hornit product you purchase. Occasionally, however, things go wrong and we want to put them right. For all faulty products, please Contact Us for return authorisation. Simply indicate the reason for your return, and the action required, refund or replacement, include your full contact information and order number if available with your return, and wrap the package securely. Please send to Bullet Ventures Limited, The Hornits’ Nest, 45 Denmark Road, Exeter, Devon, EX1 1SQ. The cost of the return postage will be the customers' liability.

(b) You agree that is reasonable for Bullet Ventures Limited to inspect the product to ascertain the cause of malfunction and to repair or replace (at its option) the defective product. Please note that Bullet Ventures Limited is under no obligation to repair or replace products damaged by water or other liquids.

(c) In the unlikely event that there is a shortage, or parts missing or other discrepancy, you must Contact Us immediately and no later than 5 days after the date of receipt at the latest. You should retain all packaging and we will do our best to resolve the issue.

(d) We will replace faulty products with the same product or refund back to a credit card if the product is no longer available. Please note that, unless otherwise stated, our returns policy is valid for only 28 days from receipt of goods.

(iii) Returning a non-faulty Product (for Hornit products bought ONLY on the Websites)

(a) If you wish to return any Hornit product you have ordered and received through the Websites for any reason, then you may return them to us within 30 days (or longer if otherwise stated) for either an exchange or refund. All non-faulty returned goods will only be accepted if in the same condition as they were sent out, i.e. in original packaging with all relevant materials enclosed, together with the original invoice. Any non-faulty returns that are not received in this way will be sent back to you at your cost or held pending contact. You will be emailed regarding this status. No replacement items can be dispatched until the returned items have been received by us. If you choose to exchange the unwanted item for an exchange totalling higher than your original, then you will be liable to pay the difference.

(b) Unless we have delivered the item to you by mistake, you will be responsible for the costs of returning the items to us. If we have agreed to carry out any enhanced or special services carried out as part of the delivery process you will not be able to cancel or receive a refund for these.

19. Ethical sourcing policy

As a reputable and trusted business committed to offering its customers high quality products, Bullet Ventures Limited recognises its obligation to ensure that suppliers are operating ethically. We expect our suppliers to consistently provide an environment which protects their employees' health and safety and basic human rights. All suppliers are expected to comply with their national employment laws and regulations with particular regard to: minimum age of employment, freely chosen employment, health and safety, freedom of association and the right to collective bargaining, no discrimination, no harsh or inhumane treatment, working hours, rates of pay, terms of employment. Bullet Ventures Limited will never knowingly source stock from countries which are in breach of the above principles. We also look to our suppliers to instill these principles when dealing with their own supplier base. Because of the sometimes complex nature of our suppliers' supply chain, it is not always possible to monitor and control the conditions of each individual involved in the production of our products. However, as Bullet Ventures Limited continues to grow it recognises the importance of being proactive and doing everything within its power to support the rights of those involved in the manufacture of its goods.
